My landlord is raising my rent: what can I do?

When a lease is renewed, the landlord may ask for a rent increase by giving written notice within set deadlines. You can accept, refuse the increase and keep your dwelling, or not renew. If you refuse, you must answer in writing within one month of receiving the notice. If you do not answer, you are deemed to have accepted the increase. Steps
  1. Check that your landlord gave you a written notice of lease modification. A simple letter asking whether you want to stay is not a notice of modification.
  2. Compare the date you received the notice with the Tribunal administratif du logement (TAL) notice-deadline table: if the landlord did not respect the deadlines, the notice is not valid.
  3. Choose your answer: accept (no need to reply), refuse the increase and renew your lease, or not renew and leave at the end of the lease.
  4. If you refuse the increase or are leaving, reply to the landlord in writing within one month of receiving the notice. The TAL offers a reply template.
  5. If you refuse, the landlord has one month from your refusal to go to the TAL. Otherwise, the lease is renewed at the same rent and on the same other conditions.
  6. If the landlord goes to the TAL, the Tribunal will apply the Regulation respecting the criteria for the fixing of rent. You can also keep negotiating an agreement at any time.
